Conditions of Participation

Participation in the competition run by Grüezi bag GmbH, hereinafter referred to as the operator or organizer, is free of charge and is governed exclusively by these terms and conditions of participation.

Procedure of the competition

The duration of the competition extends from November 28th, 2023, 8:00 a.m. to November 30th, 2023 , 11:59 p.m. During this period, users on site at the ISPO trade fair will have the opportunity to take part in the competition.

In order to take part in the competition, you must truthfully fill out and submit the participation form displayed. Only one registration submitted daily per participant will take part in the competition. It is strictly forbidden to use multiple email addresses to increase your chances of winning.

Participation in the competition is free.

Eligible Participants

Natural persons who have reached the age of 18 are eligible to participate. Participation is not limited to the organizer's customers and is not dependent on the purchase of goods or services.

If a participant is restricted in their legal capacity, the consent of their legal representative is required.

• All persons and employees of the operator involved in the conception and implementation of the competition as well as their family members are not eligible to participate in the competition. The operator also reserves the right to exclude people from participation at its own discretion if there are legitimate reasons, for example

• (a) in the event of manipulation in connection with access to or implementation of the competition, (b) in the event of violations of these conditions of participation, (c) in the event of unfair trading or (d) in the event of false or misleading information in connection with participation in the competition.
• Participation on behalf of third parties is prohibited; a fellow player may only take part on behalf of themselves. A violation would also lead to exclusion from the competition.

If necessary, winnings can also be subsequently withdrawn and reclaimed in these cases.

Implementation and processing

The winners will be determined after the closing date for participation in a random raffle among all participants (taking into account the conditions of participation). If the competition is linked to a task, only those participants who have completed the task correctly will be entered into the raffle.

The winners of the raffle will be informed promptly about their prize via a separate email.

The prize will be handed over exclusively to the winner or to the legal representative of the minor winner. An exchange, self-collection or a cash payment of the winnings are not possible. Furthermore, no claims to prizes can be transferred to third parties.

The operator will cover any costs incurred for shipping the prizes. Any additional costs associated with claiming the prize will be borne by the winner. The winner is responsible for any taxation of the prize.

Any complaints must be addressed in writing to Grüezi bag GmbH and Top Mountain Tours GmbH, stating the competition, within 14 days of the reason becoming known. Complaints communicated by telephone or delayed cannot be processed.

If the notified winners do not respond to the prize notification within 14 days of the announcement, the right to the prize will expire and a new winner will be chosen by lottery.

The winner will receive the prize stated in the competition.

End of the competition

Grüezi bag GmbH has the right to cancel or end the competition at any time without prior notice. If, for example, for technical reasons (e.g. viruses in the computer system, manipulation or errors in the hardware and/or software) or for legal reasons, proper execution of the game cannot be guaranteed.

Liability

In particular, Grüezi bag GmbH is not liable for damages that may arise from errors, delays or interruptions in transmission, disruptions to the technical systems and services, incorrect content, loss or deletion of data, viruses or in any other way when participating in competitions , unless such damage is caused intentionally or through gross negligence by Grüezi bag GmbH (its bodies, employees or vicarious agents).

To take part in the competition, you must provide personal data. The participant assures that the personal information provided by him, in particular his first name, last name and email address, is truthful and correct.

The organizer points out that all of the participant's personal data will neither be passed on to third parties nor made available for their use without their consent.

In the event of a win, the winner agrees to the publication of his name and place of residence in the advertising media used by the organizer. This includes the announcement of the winner on the operator's website and its social media platforms.

The participant can revoke his/her declared consent at any time. The revocation must be sent in writing to the organizer's contact details given in the legal notice section of the website. After consent is revoked, the participant's collected and stored personal data will be deleted immediately.

Otherwise, the data protection regulations of the individual company Grüezi bag GmbH apply.

Applicable Law

Questions or complaints in connection with the competition should be directed to the operator. Contact details can be found in the imprint section of the website.

The operator's competition is subject exclusively to the law of the Federal Republic of Germany. Legal recourse is excluded.

Severability clause

If individual provisions of the conditions of participation are or become invalid, the validity of the remaining conditions of participation remains unaffected. Instead of the invalid provision, the legally permissible regulation that comes closest to the economic sense and purpose expressed in the invalid provision applies. The same applies if there is a gap in these conditions of participation.

These terms and conditions of participation can be changed at any time by Grüezi bag GmbH without separate notification.
